American With Disabilities Act (ADA) Accommodations
The Americans with Disabilities Act (ADA) makes it unlawful to discriminate in employment against a qualified individual with a disability. The ADA outlaws discrimination against individuals with disabilities in State and local government services, public accommodations, transportation and telecommunications. An employer is required to make a reasonable accommodation to the known disability of a qualified applicant or employee if it would not impose an "undue hardship" on the operation of the employer's business.
An individual with a disability is a person who:
- Has a physical or mental impairment that substantially limits one or more major life activities;
- Has a record of such an impairment; or
- Is regarded as having such an impairment.
Procedures for Requesting ADA Accommodation
Employees can initiate the accommodation process by requesting an accommodation for a disability from the HR Department. If you believe you have a qualifying disability and are seeking an accommodation in the workplace to enable you to perform your essential job functions, contact the HR Department to begin the process as federal law requires.
The step-by-step instructions for requesting an accommodation are:
- Employee completes the Request for Accommodation Form and the Medical Release and submits this to Angie Campbell Pulido.
- Healthcare Provider completes the Medical Questionnaire for Reasonable Accommodation Document
Complete and Return both forms to the Chief Human Resources Officer.
Pregnant Workers Fairness Act (PWFA) Accommodations
The Pregnant Workers Fairness Act (PWFA) requires employers to provide reasonable accommodations to employees for conditions related to pregnancy, childbirth, or related medical conditions, unless doing so would cause undue hardship. This includes modifications like modified schedules, more frequent breaks, light duty, or temporary reassignment, among others.
The step-by-step instructions for requesting an accommodation are:
- Employee completes the Request for Accommodation Form and provide HR with any healthcare documenation necessary
- If needed, the Healthcare Provider can utilize the Medical Questionnaire for Reasonable Accommodation Document provided by Waller ISD.
Complete and Return both forms to the Chief Human Resources Officer.
